Penalties

1.  Failing to comply with the Form I-9 requirements:

Penalties to departments for record keeping violations range from $100 to $1,100 per form. Knowingly employing an unauthorized alien could cost departments $275 to $11,000 per violation.

2.  Hiring or continuing to employ unauthorized aliens:

Employers determined to have knowingly hired unauthorized aliens (or to be continuing to employ aliens knowing that they are or have become unauthorized to work in the U.S.) may be ordered to cease and desist from such activity, and pay a civil money penalty as follows:

  • First Offense:  Not less than $250 and not more than $2000 for each unauthorized alien;
  • Second Offense:  Not less than $2,000 and not more than $5,000 for each unauthorized alien; or
  • Subsequent Offenses:  Not less than $3,000 and not more than $10,000 for each unauthorized alien.

3.  Engaging in a pattern or practice of knowingly hiring or continuing to employ unauthorized aliens:

Persons or entities who are convicted of having engaged in a pattern or practice of knowingly hiring unauthorized aliens (or continuing to employ aliens knowing that they are or have become unauthorized to work in the U.S.) may face fines up to $3,000 per employee and/or 6 months imprisonment.
