Common Errors
Section 1
Here is a list of common errors and the steps to address them for Section 1 of the I-9 from.
1. Was not been signed by the employee.
- The employee must sign Section 1 and note "updated" (month/date/year) using the current date.
2. Was not dated by the employee.
- Have the employee date with current date, initial and note "updated" after the date.
3. Was not completed on or before the date of hire.
- No correction possible for this error, unless the form was mis-dated.
- Review process to assure future compliance.
- Send a violation letter to the approver and the approver's supervisor.
4. The citizen box was not checked by the employee.
- The employee must check the appropriate box, inital and date with the current date and note "updated" after the date.
5. Employee left information missing, such as date of birth, Social Security number or home address.
- The employee must complete the missing information and inital and date where completed.
Section 2
Here is a list of common errors and the steps to address them for Section 2 of the Form I-9.
1. List A or Band C not completed (or completed incorrectly).- HR can fill in accurate information and sign and date (current date) with the notation “updated.”
2. The documents provided by the employee are not acceptable (not included in List A, B, or C).
- HR should correct, initial and date (current date) with the notation "updated".
3. The employee's hire date is missing.
- HR can fill in the hire date, initial and date with the current date.
4. Missing or incomplete employer information.
- HR can fill in the needed info, initial and date (current date) with the notation "updated".
5. Not signed by the employer.
- HR must fill in, sign and date (current date) with the notation "updated".
6. Not dated by the employer.
- HR must date (current date) Section 2 with the notation "updated".
7. Not completed within 3 days from hire.
- No correction possible for this error, unless the form was mis-dated.
- Review the process to assure future compliance.
- Send a 3-day violation letter to the approver and the approver's supervisor.
Section 3
Here is a list of common errors and the steps to address them for Section 3 of the I-9 form.
1. The employee's employment Authorization has expired and Section 3 is not completed.
- The employee must provide renewal information.
- HR must complete Section 3 and sign/date with current date.
